By visiting, accessing, or purchasing from www.nataliahubbert.com (the “Website”) and/or engaging the services of Natalia Hubbert (the “Consultant”), you agree to be bound by the following Terms and Conditions (“Terms”). These Terms apply to all site visitors, customers, and users of the site.
1. Services Provided
Natalia Hubbert provides Depth Consultation (non-clinical psychological inquiry) and Original Artwork/Artistic Services. By purchasing any Service or Product, you acknowledge that you have also read and agreed to the Disclaimer & Waiver, which is incorporated herein by reference.
2. Electronic Communications
Visiting the Website or sending emails to the Consultant constitutes electronic communications. You consent to receive electronic communications and agree that all agreements, notices, and disclosures provided to you electronically satisfy any legal requirement that such communications be in writing.
3. Intellectual Property Rights
All content included on this Website—including but not limited to original artwork, images, text, graphics, logos, and digital products—is the exclusive property of Natalia Hubbert and is protected by United States and international copyright laws.
Limited License: You are granted a revocable, non-transferable license to access the site for personal use.
Prohibited Use: You may not modify, publish, transmit, reverse engineer, create derivative works, or in any way exploit the content (including art portfolio images) without express written permission from Natalia Hubbert. Unauthorized use of artwork or intellectual property may result in legal action.
4. Cancellation & Refund Policy
Depth Consultation Sessions: Cancellation or rescheduling must occur at least 24 hours in advance. Failure to provide 24-hour notice will result in a forfeiture of the session fee.
Session Packs/Subscriptions: No refunds are available for unused sessions within a package once the first session has been completed or after 7 days from the date of purchase, whichever comes first.
Digital Products/Courses: No refunds are available once the digital content has been accessed or downloaded.
Physical Art: All sales of original artwork are final unless otherwise specified in a separate Bill of Sale.
5. Third-Party Services
The Website may contain links to third-party sites (e.g., payment processors like Stripe or PayPal). Natalia Hubbert is not responsible for the content or practices of these sites. Your use of third-party functionality is subject to their respective terms and privacy policies.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATALIA HUBBERT SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE WEBSITE OR SERVICES. All information and services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. If you are dissatisfied with any portion of the service, your sole and exclusive remedy is to discontinue use.
7. Indemnification
You agree to indemnify, defend, and hold harmless Natalia Hubbert from any losses, costs, liabilities, and expenses (including reasonable attorney’s fees) relating to or arising out of your use of the Website, your violation of these Terms, or your violation of any rights of a third party.
8. Dispute Resolution: Binding Arbitration
In the event of a dispute that cannot be resolved through good-faith negotiation, the parties agree that such dispute shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) in a location mutually agreed upon within Harris County, Texas. The arbitrator’s award shall be final. The parties waive their right to a jury trial or to participate in a class-action lawsuit.
9. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Texas. You hereby consent to the exclusive jurisdiction and venue of courts in Harris County, Texas, for all disputes arising out of or relating to the use of this Website or Services.
10. Severability & Entire Agreement
If any part of this agreement is determined to be invalid or unenforceable, the remainder of the agreement shall continue in effect. This document, along with the Disclaimer and Privacy Policy, constitutes the entire agreement between the User and Natalia Hubbert.
